Joel Hazel’s practice focuses on medical malpractice defense; successfully defending hospitals, physicians, nurses, and other medical professionals in Idaho and Washington courts. Joel has successfully defended large hospital systems from a variety of claims of medical malpractice in both Idaho and Washington including claims of psychiatric malpractice, birth injury, failure to diagnose neurological injuries, failure to diagnose cardiac issues and delayed diagnosis of cancer. 

Prior to joining Witherspoon Kelley, Mr. Hazel tried numerous criminal jury trials from 1994-1999 as Deputy Prosecuting Attorney for Kootenai County, Idaho.  These matters included complex narcotic trafficking jury trials and multiple first degree murder jury trials.  Mr. Hazel carried a felony caseload throughout most of his tenure at the Kootenai County Prosecutor's office.

Mr. Hazel is also experienced in real property disputes, commercial and business litigation, eminent domain, and employment law. Joel has tried many cases before both judges and juries in Washington and Idaho courts.

Representative Cases

  • Idaho Department of Transportation v. Zimmerman (Bonner County, Idaho, 2015)

Mr. Hazel was trial counsel in a two week jury trial over property valuation in a condemnation matter.

  • Quass v. Valley Hospital and Medical Center (Spokane County Superior Court, 2013)

    Mr. Hazel was trial counsel in a wrongful death case in which plaintiffs alleged hospital's substandard nursing care resulted in patient falling out of bed leading to her death.  A 4-week trial resulted in a plaintiffs' verdict that was a fraction of the settlement demand and well below the hospital's final settlement offer.
  • Sherman Storage v. Global Signal  159 Idaho 331, 360 P.3d 340 (Kootenai County, Idaho, 2015)

Mr. Hazel successfully defended a cell tower company at trial in a boundary line dispute and his client was awarded significant attorney's fees and costs.  In addition, Mr. Hazel successfully briefed and argued the case on appeal and his client was awarded all attorneys' fees on appeal.

Mr. Hazel was trial counsel in a medical malpractice claim involving an intra-operative overdose of epinephrine to a patient.  The three week jury trial resulted in a verdict that was a fraction of the settlement demand by the patient before trial. 

  • Kootenai County, Idaho, 2006

Mr. Hazel obtained a defense verdict after a two week jury trial in a psychiatric malpractice case where the plaintiffs alleged a psychiatrist failed to prevent a patient's suicide.
