Emily Arneson’s primary areas of practice include the transactional and litigation aspects of employment, health, and media law. She counsels employers on issues such as employee handbook review, large reductions in labor force, employment contracts for highly-compensated individuals, and employer obligations under state law, such as the Washington Law Against Discrimination (WLAD), and under federal law, including the Family Medical Leave Act (FMLA), the National Labor Relations Act (NLRA), the Americans with Disabilities Act (ADA), and Uniformed Services Employment and Reemployment Rights Act (USERRA).

Having formerly represented employee-plaintiffs in state and federal employment retaliation and discrimination cases, FMLA enforcement, and unemployment compensation administrative appeals, Emily brings practical experience and valuable perspective to the representation of employers. Additionally, she has experience with copyrights, trade secrets, and trademarks, as they relate to the employment setting.

Emily has litigated public records cases and appeals for media entities, and is a board member and legal committee member of the Washington Coalition for Open Government. She also furthers the cause of access to government through various speaking engagements and panels. With regard to health care, Emily regularly presents at seminars concerning health care providers’ obligations under HIPAA and various state health information privacy laws, in addition to counseling clients regarding labor relations, medical record maintenance, and telemedicine.

Prior to joining Witherspoon Kelley, Emily practiced elder law in Tacoma, focusing on state planning, guardianships, and probate. During law school, she externed for Chief Judge Robert H. Whaley of the United States District Court, Eastern District of Washington.
